Legal Considerations Overview

As professionals working in a highly creative industry, graphic designers need to be familiar with various rules and regulations related to the industry. These legal considerations not only are important for ensuring fair working and payment terms for the designers but also are critical for protecting their work against intentional or unintentional misuse. When there is a breach of legal terms and/or conditions, graphic designers need to communicate the problem with the defaulting party and arrive at a resolution.

This activity will help you understand the steps to resolve a certain type of breach related to legal terms and conditions.

Scenario

You work as a freelance graphic designer and regularly post some of your copyrighted images and custom graphics on various open access resource websites. The license states that they are not available for commercial use. While browsing online, you discover that one of your copyrighted graphics has been used on the website of a well-known social media influencer.

You found the following names on the defaulting website:

·        What might happen if you select another mode of communication?

Potential Issues and Solutions

5.    Explain the legal issue to the stakeholders. Consider the following questions to guide your response:

·        What has the website done that breaches legal terms and/or conditions?

·        Why is it a breach of terms and/or conditions?

6.    Communicate a solution for the identified legal issue to the appropriate stakeholder(s). Consider the following question to guide your response:

·        What do you want the stakeholder(s) to do next?

·        Are there any alternatives that can be considered?

What to Submit
